While less serious than felonies, misdemeanors are nevertheless very serious criminal charges. The conviction of a misdemeanor can result in a jail sentence of up to one year, in addition to probation and fines of up to $1,000.00. A misdemeanor conviction will result in a criminal record that carries with it, its own distinct problems. There are three levels of misdemeanors and are classified by the quantum of punishment that can be meted out upon conviction: Class A Misdemeanor: A class A misdemeanor is the most serious offense short of a felony. Common class A misdemeanor charges include: assault in the third degree; reckless endangerment in the second degree; criminal trespass in the second degree; petit larceny; and, aggravated harassment in the second degree. Potential criminal penalty include: one year imprisonment; a 'split sentence' (60 days imprisonment/3 years probation); fines up to $1,000.00 and/or probation. Class B Misdemeanor: While less consequential than a class A misdemeanor, a conviction for a class B misdemeanor is nevertheless a very serious matter. Potential criminal penalty include: 3 months imprisonment, a split sentence (3 months imprisonment/1 year probation); probation; and/or fines up to $500.00. Unclassified Misdemeanor: These charges carry with them varying degrees punishment but are limited to those of a class A misdemeanor. The Law Office of Matthew C.
