Aggravated Unlicesed Operation of a Motor Vehicle Third Degree"A person is guilty of the offense of aggravated unlicensed operation of a motor vehicle in the third degree when such person operates a motor vehicle upon a public highway while knowing or having reason to know that such person's license or privilege of operating such motor vehicle in this state or privilege of obtaining a license to operate such motor vehicle issued by the commissioner is suspended, revoked or otherwise withdrawn by the commissioner." (Vehicle and Traffic Law 511[1][a]). In the vast majority of cases, the individual charged with this offense has an unresolved traffic ticket that has resulted in a suspended license. As stated above, AUO 3rd is a crime (a misdemeanor). Thus, a conviction for AUO 3rd would result in a criminal record. Additionally, the court is empowered to sentence you with up to 30 days in jail and a fine up to $500.00 plus surcharge. Your insurance might also increase and, if you ever have your driver's license revoked, a conviction of AUO 3rd carries with it a substantial number of negative units. The Law Office of Matthew C. Generally, individuals are charged with AUO 2nd where the underlying suspension is alcohol-related or where the individual has multiple suspensions. A conviction of AUO 2nd can result in a jail sentence of up to 180 days, a minimum fine of $500.00 or probation. Generally speaking, an individual can be charged with AUO 1st if they commit AUO 2nd while under the influence of drugs or alcohol, has 10 suspensions or a permanent revocation of their license.
