Recently, New York has established a new DWI offense, Aggravated DWI. Individuals may be charged with Aggravated DWI if their BAC is determined to be 0.18 or higher. Aggravated DWI is a felony offense and the penalties are much harsher than that of an ordinary DWI. In addition, the law places significant restrictions on plea bargaining an aggravated DWI. Update: On December 18, 2009, an otherwise misdemeanor DWI charge is transformed into an aggravted DWI (felony) if there is a child 15 years of age or less in the vehicle.
